What is an Automatic Stay?

An automatic stay is considered a powerful legal tool designed to provide immediate relief to individuals or businesses facing financial difficulties. Put simply, it is a legal injunction that halts creditors and collection agencies from pursuing debts or taking legal action against you. This essential protection is initiated the moment you file for bankruptcy, whether it's under Chapter 7, Chapter 11, or Chapter 13.

However, it does not protect you from all collection actions. Some collection actions that can occur after you file for bankruptcy include:

  • Creditors or lenders can still contact you to discuss the debt
  • Creditors can still sell assets that are not protected by the bankruptcy
  • Creditors can still sue you and take your non-exempt assets
  • You may still be liable for post-petition debts
  • You may still be liable for taxes, fees, and penalties
  • What should I do if I'm considering filing for bankruptcy protection?
If you are considering filing for bankruptcy protection it is important to speak with an experienced attorney who can review your unique situation and provide legal advice so that you can move forward and find financial freedom.
  • Does filing for bankruptcy mean my business will close?
Not necessarily. Depending on the chapter of bankruptcy that is filed, a business may be able to continue operations while reorganizing their debts in a payment plan.

How to Qualify for Automatic Stay Protection

In order to qualify for the automatic stay, you must file a petition for bankruptcy. There are two types of bankruptcy that you can file for:

  • A consumer bankruptcy, which is used by individuals
  • A business bankruptcy, which is used by businesses

Once you file, the court will assign you a bankruptcy trustee. The trustee will investigate your finances and advise the court on what type of bankruptcy is best for you.

Once the court issues the automatic stay, you will be protected from most collection actions. The automatic stay will last until your case is closed. Once your case is closed, the automatic stay will become a discharge order, which will eliminate your debts and prevent further collection action.

How Can Our Automatic Stay Attorney Help You?

Navigating the complexities of automatic stays requires legal expertise and a deep understanding of bankruptcy laws. Our team can assist you with the following:

  • Comprehensive Legal Assessment: We can thoroughly evaluate your financial situation, identifying key factors that can impact the success of your automatic stay. This includes assessing the type of bankruptcy best suited to your needs – whether Chapter 7, Chapter 11, or Chapter 13.
  • Timely Filing and Documentation: Timing is crucial when it comes to filing for bankruptcy and initiating an automatic stay. We can ensure timely filing and meticulous documentation, maximizing the protection afforded by the automatic stay and minimizing potential challenges.
  • Creditor Communication Management: We can take charge of all communication with creditors, providing you with the space to focus on rebuilding your financial stability. We can handle negotiations, ensuring that your rights are protected throughout the bankruptcy process.
  • Strategic Planning for Debt Resolution: Beyond the immediate relief offered by an automatic stay, we work collaboratively with you to develop a strategic plan for debt resolution. Whether it involves liquidation, reorganization, or a structured repayment plan, we tailor our approach to meet your unique circumstances.
  • Post-Bankruptcy Guidance: Our commitment doesn't end with successfully implementing an automatic stay. We help you understand the implications of the bankruptcy discharge and assist in rebuilding your financial future.
