Estate Planning

At Bilu Law, we know developing a plan for your estate is one of the most important tasks you’ll undertake. We work to ensure every base is covered so that you can relax.

Our Florida estate planning attorneys create estate plans that facilitate the handling of taxes, wills, insurance, property, and trusts. Our attorneys possess significant knowledge in this ever-changing area of law.

We handle estates from the simple to the complex and offer a wide range of services, including:

  • Health-Care Surrogates
  • Charitable Gift Planning
  • Estate Tax Planning
  • Living Trusts
  • Wills and TrustsLiving Wills
  • Durable Powers of Attorney
  • Wills & Trusts
  • Revocable and Irrevocable Trusts

Too many people wait to establish wills and trusts because they simply don’t want to think about it. It is, however, very important to put your wishes in a legal document so that they can be carried out and not challenged. Frankly, if your wills and trusts are not set up correctly, you might as well not have done them.

Often, people think that if they don’t yet have children, they don’t need a will. Everyone should have a will. You may have assets you don’t realize are in your possession or not included in your existing estate plan. If you die without a will, a court will decide how to distribute those assets.

One quite common situation occurs when one spouse dies, followed shortly by the death of the surviving spouse.

Florida law says the first spouse’s assets go to the surviving spouse. But, when that second spouse dies, all of the assets go to the second spouse’s family. The first spouse’s family gets nothing.

A simple will can make sure your assets go to whomever you wish.

Trusts are also a vital planning tool. In many cases, trusts can save an estate a good deal of money on taxes. We can advise you on whether your estate and your goals warrant establishing a trust. Then we can draft a trust that will achieve those goals. We handle revocable and irrevocable trusts and living trusts. We also will administer trusts on clients’ behalf.

Living Will & Health-Care Surrogate

If you think telling your spouse how you want medical decisions to be handled when you are incapacitated is sufficient, you’d better think again.

By creating a living will and appointing a health-care surrogate, you can be assured that your wishes will be carried out. Doctors will know what measures to take, and your family will be reassured that this truly is what you want.

Under new federal privacy laws, appointing a health care surrogate is even more important. Doctors do not have to provide your family with vital medical information unless you have given them the right to do so. This is increasingly a problem for parents of college-age children who cannot get medical information about their sick or injured children.

Our firm advises all adults to appoint a health-care surrogate. We can help prepare surrogate documents – as well as living wills – that will meet your desires.

Durable Power of Attorney

You never know when an injury or illness will leave you unable to communicate or to perform basic financial tasks. Young or old, you should have a durable power of attorney giving someone you trust implicitly the responsibility for financial decisions should you become incapacitated.

A durable power of attorney is not difficult to enact, but the headache and heartache it can spare is priceless. Let Bilu Law assist in establishing this vital planning tool for you or your loved ones.

Real Estate Law

The Florida real estate attorneys at Bilu Law handle every aspect of residential and commercial real estate. We make buying and selling property as stress-free as possible by handling all of the details for you. Clients trust us to get the details right the first time. We enjoy an excellent reputation among real estate agents and regularly receive referrals from them. We perform thorough title searches, help obtain title insurance, and review financing contracts and sales contracts. We are known for our ability to recognize the potential for problems and for ensuring they are immediately resolved.

Foreclosures, Loan Modifications, Banking & Finance

Our firm assists depositors, lenders, and borrowers in accordance with navigating the intricate state and federal banking statutes and regulations that affect their deposits, loans, and other credit arrangements. We have experience helping our clients through lending and secured transactions, loan workouts, mortgages and foreclosures, financing, and venture capital or private lending arrangements.

Real Estate Litigation

Our real estate attorneys use their skills as litigators to defend and prosecute your claims as the buyer or seller of real estate. In addition to breach of contract, we handle actions over deposits/earnest money, specific performance of purchase agreements and breach of covenants and warranties. Our firm works closely with property owners and landlords who have problems with difficult tenants who require eviction. As is frequently the case, once these tenants have been evicted or move out (sometimes secretly and frequently without forwarding addresses), landlords are left with hundreds or even thousands of dollars in damages. At this point, we coordinate our real estate work with our collections department to obtain full relief for property matters, including unpaid rent, expenses, and deficiencies.

Real Estate Closings

The Law Offices of Bilu Law has been representing buyers and sellers at real estate closings for more than three decades. We are independent of other parties to the sale; therefore, we represent only our clients and work to ensure their rights are protected.

We will take care of title insurance along with a closing when our client is responsible for it. We also handle closings on refinancing. We often receive referrals from title companies and mortgage brokers. Many people ask us what Title Insurance is and why is it so important? Quite simply, when you’re buying and selling property, you need a rock-solid title search and title insurance. The real estate attorneys and paralegals at Bilu Law can do both. Our searches can unearth a host of problems that could jeopardize a title to a property including defective property descriptions, liens, unpaid municipal charges, and even forgery. Count on us to protect your rights in a real estate deal, especially in these unpredictable financial times.

We handle articles of incorporation and partnership documents, help formulate business plans, and provide counseling and litigation services when conflicts arise.

We provide a wide range of services for business clients beginning with the selection of the type of organizational entity to the preparation of shareholders’ agreements, to providing advice on business matters, to defending and prosecuting litigation in a number of legal areas, including:

Small Business & Corporate Law

Our attorneys have significant experience reviewing and drafting contracts for the needs of every business. We prepare contracts that accurately and completely reflect your intent and protect your interests. Often, a well-drafted contract can prevent litigation. We draft and advise businesses on leases, employment and shareholders' agreements, non-compete agreements, franchise agreements, partnership agreements, commercial and residential real estate purchase/sale agreements, and any other type of business agreement.

Business Litigation

Protecting your business requires vigilance and preventative strategies. As your business grows and becomes more successful, disputes may arise, and litigation may become necessary to resolve a dispute. At Bilu Law, we seek to minimize the burdensome nature of litigation for our clients. We employ a number of resources to reduce the time and money required of our clients in litigating and resolving a case. We focus on thorough research, case preparation, time management strategies, and on-point consultations with our clients to streamline processes involved in hearing cases.

Our team of lawyers fights to defend our clients and their businesses in both state and federal courts. At Bilu Law, we work to resolve complicated problems efficiently and economically by identifying the shortest path between what you want for your business and what you need to solve your problem. When businesses face disputes in court or potential litigation, any interruption to daily operations often means a loss of revenue. The impact of lost opportunities and resources are hard to quantify.

That's why our goal is to get your business back to full speed as quickly as possible. We want you to devote your time and energy to what is most important to you - securing new customers and keeping your existing customers satisfied.

Accessible & Results-Oriented Legal Support

Count on us to protect your rights, especially in these unpredictable financial times.

Solving Problems Efficiently

Our attorneys are sensitive to the needs of our business clients. Going to trial and the entire process of litigation can be time-consuming and costly. If you are deposed or are required to respond to discovery requests, you have less time to focus on the needs of your business. This means you may need to stop what you are doing and assign people and resources to meet these requests. Given what is involved, our attorneys realize trial and litigation can interrupt the routine of your business and create extra costs.
